How to serve a Statutory Demand on an Individual

Statutory Demands are a formal written request for payment of a debt owed by a individual or company.

When used correctly, serving a Statutory Demand is a quick and effective way of recovering an overdue account. The debt should be undisputed and be for £750.00 or more.

You must do everything possible to bring this to the attention of the debtor and it is important to ensure the Demand is served correctly particularly where the substituted service route is followed. Failure to adhere to Insolvency Rules relating to service may mean the Court will not allow you to proceed further. Once the Demand has been served a Certificate of Service will need to be completed in a specific format.

In our opinion, the best way to ensure the Statutory Demand is served correctly is to employ an experienced  Process Server to serve this for you. A Process Serving Company will ensure the Demand is served correctly and will provide you with a Certificate which can be used if needed.

Which Statutory Demand Form should I use:-

For an individual or sole trader use one of these three statutory demand forms:

form 6.1 – for a specific amount payable now

form 6.2 – for a specific amount payable now following a judgment or a court order

form 6.3 – debts payable in the future

For a registered or unregistered company you have to use statutory demand form 4.1
